ADVANCE PAROLE

Advanced paroles are permits for a non-U.S. national, who do not own a valid immigrant visa. To reenter the United States after traveling abroad, they have to obtain an advance parole by filing for an I-131 Form (“Application for Travel Document”), with supporting documentation, photos and a fee, at a local USCIS office.

HOW DO I KNOW IF I’M ELIGIBLE FOR ADVANCE PAROLE?

eligible

Aliens in the United States should, prior to departure, obtain Advance Parole to reenter the United States after travel abroad if they:

  • Filed an application for adjustment of status but have not received a decision from the USCIS.
  • Possess an urgent personal or bona fide reason to travel temporarily abroad.

Any adjustment of status applicant who leaves the US without advance parole is automatically considered abandoning his/her application for adjustment of status. Such a person will not be allowed back in the US. The person would have to do consular processing while remaining out of US.

ineligble

  • Aliens in the United States that want to leave the country, but are still not eligible for Advance Parole if they are:

    • In the United States illegally
    • An exchange alien subject to the foreign residence requirement.
    • Should obtain a different type of I-131, such as a Reentry Permit or a Refugee Travel Document

Please note that Advance Parole does not guarantee admission into the United States. Aliens with Advance Parole are still subject to the immigration inspections process at the port of entry.

frequently asked questions

  • A copy of a document showing your current status in the US

  • An explanation (or evidence) for the circumstances that prove why you qualify for an Advance Parole

  • Prepared and signed Form I-131, Application for Travel Document

An advance parole document is valid for up to one year. During that period, every alien can enter and exit the United States multiple times.
