要求
1. 理解行为的实施及后果。立遗嘱者必须明白他是在做什么，明白实施这个行为的后果。也就是说，立遗嘱者必须意识到他是在做遗产分配的计划，是在对身后事宜做出安排。
2. 知道财产的性质和范围。立遗嘱者必须知道，或者应当知道他财产的大致的性质和范围。但是立遗嘱者不需要能够提供他所拥有的每一项财产的精确账目和价值。立遗嘱者所认为的自己财产的多少，和财产实际上的多少之间的差别越大，他就越有可能被认为是缺乏立遗嘱资格。
3. 能认出继承人。立遗嘱者必须知道，或者应当知道通过其死亡通常会得益的人(即假定的继承人，比如配偶、子女、父母、孙子女和兄弟姐妹)。但是，立遗嘱者不是必须要留财产给这些人，他没有这个义务。如果仅仅因为立遗嘱者的遗嘱中的财产分配看起来不公平或者异乎寻常，则并不意味着立遗嘱者就缺乏立遗嘱资格。
4. 同时具备前三个要求直到做出合理的决定。立遗嘱者要同时符合前三个要求，并且要持续一段足够长的时间，直到做出一个合理的决定。
5. 书面形式。一般来说遗嘱应该是书面形式的，即打印出来的、用打字机打出来的，或者是以其它的有形形式存在的。
6. 立遗嘱者的签名。立遗嘱者在遗嘱上签名可以保证他实际上认可了这个遗嘱，也表明了遗嘱已完成，反映了他最终的愿望。立遗嘱者签名时，见证人在场是比较好的做法。立遗嘱者的签名一般都要在遗嘱的末尾进行。
7. 见证人。几乎所有的州都要求至少有两个见证人。有一些州对见证人加以最低年龄限制，比如14岁或者18岁。见证人必须是有能力的和可靠的。见证人并不需要知道立遗嘱者的遗嘱的内容。一般来说，见证人的签名应该在遗嘱的末尾并且在立遗嘱者的签名之下。
