Navigating the complexities of the EB-1C visa process can be daunting, especially for a small company. Today, we share the remarkable journey of our client, the chairman of a US logistics company with only seven employees, and how we helped him secure not one but 2 EB-1Cs despite a prior denial. This story highlights perseverance, strategic planning, and the unwavering determination of our client.
The Challenge of Securing 2 EB-1Cs
Our client, the chairman of a US logistics company, faced a daunting situation. Despite the company having only seven employees and a prior denial, he needed to secure two EB-1Cs. One was for an executive already in the U.S. on an L-1A and the other was for himself. For this second EB-1C we’d be applying for the green card directly. This was no easy task, given the stringent requirements for proving that both the US and foreign companies were led by top-notch executives.
Our Approach To This Challenging Situation
For this case to be successful and allow us to secure the 2 EB-1Cs, we knew we would need to do things a little differently than we normally would. So we did three unique things when preparing this case.
Utilizing AILA Articles and USCIS Memos
We included all relevant articles by AILA and USCIS memos, along with industry news about this logistics company. We aimed to highlight the purpose and rationale behind the EB-1C category as a whole, emphasizing the US’s desire for top-notch executives to build companies that contribute to the country’s greatness.
Crafting a Mini EB-1A Case
We merged elements of an EB-1A case into our EB-1C application. By showcasing that the chairman of the company was a top-level executive with a PhD, experience overseas, and significant net worth, we underscored his extraordinary abilities. Despite the small size of the US company, we argued his background justified a green card under either EB-1C or EB-1A.
Writing a Compelling Business Plan
We also drafted a robust business plan to explain why this logistics company would thrive under his leadership. We analyzed the logistics industry in the US and globally, demonstrating how his expertise could transform the broken supply chain and lead the company to success.
Preparing for the Worst: Expecting Difficult RFE for 2 EB-1Cs
Anticipating a difficult RFE (Request for Evidence), we began preparing immediately. Surprisingly, after filing the case, we received a very simple RFE requesting a few documents and explanations. Although we could have responded quickly, our client insisted on treating it as a difficult RFE, and wanted us to take more time to prepare a very thorough response. This cautious approach ensured we left no stone unturned.
Thorough Preparation
In our cover letter, we included the RFE, the request, and each of the required documents. We also provided the entire package in a brand-new format with all supporting documents and new evidence. This meticulous preparation paid off.
The Outcome: 2 EB-1Cs Approved
In the end, this case was approved. The interviews went smoothly and we secured 2 Eb-1Cs for this small, logistics company with just 7 employees. The whole family also received their green cards, marking the successful end of a challenging journey.
