REENTRY PERMIT

The purpose of a reentry permit is to allow permanent residents to leave the US for an extended amount of time without abandoning their permanent residence. If a US permanent resident wants to take a long trip abroad, they may apply for a re-entry permit. These permits are issued for up to two years and establish your permanent residency.

CASE PROCESSING OVERVIEW

Tsang & Associates focuses on the efficiency of the process and to do that we focus on expediting the process. Below are the steps and how long we estimate it will take based on previous clients.

STEP 1: PREPARE AND FILE EXPEDITED PERMIT REQUEST

We help you prepare your expedited request statement, including the details of your travel urgency and the consequences of your inability to leave the U.S. We collect and complete the paperwork and file in 1-2 days. For our overseas clients, we file the same day of your arrival to the U.S.

Time: Same day processing

STEP 2: REQUEST USCIS SUPERVISORY REVIEW

We contact USCIS and make the expedited request for supervisory review so that your case is expedited the moment that USCIS receives it.

Time: Within 1 week

STEP 3: OBTAIN APPROVAL FOR EARLY BIOMETRICS

We contact the biometrics center to get approval to schedule your biometrics early. Once approval is received, we accompany you to the biometrics center to complete the biometrics process. For our overseas clients, you are able to fly back to your home country once the biometrics process is complete.

Time: 10-20 days from date of filing

STEP 4: PROCESSED BY USCIS & PERMIT RECEIVED IN 2-4 MONTHS

USCIS will send your permit in 2-4 months. Once we receive your permit, we will FedEx it to you on the same day.

Time: 2-4 days depending on international mailing

FREQUENTLY ASKED QUESTIONS

HOW LONG WILL MY REENTRY PERMIT BE VALID?

A reentry permit will be issued to a lawful permanent resident and is valid for 2 years. If someone is going to be out of the country for more than 4 of the last 5 years then the permit will be limited to only 1 year. The only exceptions to that is if: a permanent resident whose travel is because of the US Government; if that resident is employed by a public international organization, which the US has treaties with OR if the resident is a professional athlete and competes in the US and worldwide.

WHAT ARE THE REQUIRED DOCUMENTS AND WHERE CAN I FIND THEM?

  • Prepared and signed Form I-131, Application for Travel Document (Found Here)

  • Copy of a photo identity document (with photo, name and date of birth) such as an Employment Authorization Card or driver’s license

  • Copy of Form I-797, Notice of Action, that proves your I-485 application was accepted (This will be provided by the USCIS)

  • Two identical passport-style color photographs

WHERE DO WE TURN IN ALL THE DOCUMENTS?

The documents will be turned into Application Support Centers (ASC). They offer fingerprinting services, usually after filing. All of the offices can be found Here.

WHAT IF I DON’T WANT TO REENTER IN CALIFORNIA?

Can I get a Green Card with a B-1 visa?

To qualify for getting the B1 visa, you must prove that you will return to your home country. This means that you cannot have plans to stay in the US permanently. Because you have to prove this and state it during your interview, it is then very difficult to get a Green Card while on a B1 visa.In order to be able to get permanent residence with a B1 visa, you must either:

  • Have family in the US and apply to join them
  • Marry a US citizen with a valid marriage and then apply for permanent residence
  • Find a job in the US where the employer is willing to sponsor your visa such as the H-1B visa, and then apply for the Green Card

However, since the B1 visa is a business visitor visa, if you find a job in the US you will be unable to work for the company in your home country. This means that you will have to go through complicated procedures to change your status and prove that you did not intend to find a job in the US, but that an unexpected opportunity came your way.
